Terms of Service

These Terms explain how Budapest Canvas takes orders, produces, sells, and delivers hand-painted artworks. By placing an order, you agree to the process, timelines, payment terms, and handmade nature of the final artwork.

The Hungarian version of this legal page governs.

Scope of these Terms

Budapest Canvas is the trade name and brand of Biot.ai Lab Kft. These Terms apply when you use the Budapest Canvas website, place an order through checkout, buy a ready-made artwork, order a made-to-order painting, or accept a written bespoke or business proposal from us. If a separate written agreement is signed for a particular project, that agreement applies to the extent it differs from these Terms.

Definitions and customer types

These Terms may treat consumer and business orders differently, as well as different artwork types. A consumer is a natural person acting outside their trade, profession, or business activity. A business customer is a person or entity ordering for business, professional, institutional, or commercial purposes.

  • Ready-made artwork: a finished, in-stock painting available for purchase.
  • Painting made from a catalogue concept: a hand-painted artwork created after the order based on a concept shown on the website, typically in the selected size, medium, and framing option.
  • Personalised or custom commission: a non-prefabricated artwork created based on your express instructions, own references, photos, personal requirements, or unique brief.
  • Consumer withdrawal, statutory warranty, and complaint-handling rules apply to consumers. Business customers are governed by the individual written offer, the parties' agreement, and general civil-law rules.

Artwork concepts and final paintings

Budapest Canvas sells original hand-painted artworks and commissioned paintings. Images shown online as concepts are visual references for a painter, not digital products, prints, or guarantees that every brushstroke, colour, texture, or small detail will be identical in the final canvas.

  • The final artwork is made by hand on canvas by an artist from our Hungarian artist community.
  • Natural variation in brushwork, surface texture, colour, scale, edge detail, and interpretation is part of the handmade process.
  • We may make reasonable curatorial or technical adjustments so the concept can be painted well at the selected size, medium, and framing option.

Technical steps of ordering

During online ordering, you select the artwork or concept, size, medium, framing, and delivery details, then you can review the cart and order details before payment. Incorrect details can be corrected before payment. The contract language is the language selected during the ordering process. If the language versions differ, for consumer contracts the version accepted by the consumer during ordering governs; the Hungarian version is the basis for our internal interpretation and Hungarian-law compliance.

  • An online order does not qualify as a written contract. We confirm the order electronically and keep order data for customer service, fulfilment, accounting, and legal purposes.
  • The current version of the accepted Terms is made available in the confirmation email or as a downloadable version on the website. A copy of the order data can be requested via the contact email address.
  • The contract is formed when payment is successfully completed and we confirm the order, or, for bespoke or business offers, when you accept the offer and complete the agreed payment step.
  • We do not apply a separate code of conduct. By placing the order, you submit an order involving a payment obligation.

Prices, payment, and data review

Website prices are stated in EUR. Prices shown to consumers are gross prices and include applicable taxes unless expressly stated otherwise. Shipping is calculated during checkout where available, or confirmed in a quote before payment for destinations or orders that require manual handling.

  • Payments are processed by Revolut. We do not store full card details.
  • Studio work begins only after payment is confirmed.
  • The technical success of payment alone does not mean final acceptance that the order can be fulfilled if the order cannot be fulfilled due to an obvious error, unavailability, or impossible delivery. In that case, we will promptly coordinate with you or refund the amount paid.
  • If checkout cannot calculate a suitable delivery option, we will confirm the shipping method and cost before payment.

Production process and timing

After payment, we review the order, match the brief with a suitable painter, and turn it into a paid studio brief. Made-to-order paintings are usually expected to take 4-8 weeks to complete, depending on the selected size, medium, framing, artist capacity, drying time, and final review. If a material deviation from this is expected, we will inform you separately and coordinate the next steps.

  • We may contact you if the brief, delivery address, selected size, or framing choice needs clarification.
  • Before shipping a made-to-order painting, we send a final photo for review.
  • If the final photo shows something materially different from the agreed direction, we will work with the artist on reasonable adjustments before dispatch.

Withdrawal and voluntary cancellation option

As a consumer, your statutory withdrawal right applies to ready-made, in-stock artworks: for such products, you may withdraw without giving a reason within 14 days from delivery. You may also exercise the withdrawal right between contract formation and delivery. A catalogue concept made after your order in the selected size, medium, and framing, as well as a personalised or custom commission, is a non-prefabricated product; for artworks made on the consumer's instruction or express request, the consumer may not exercise the 14-day no-reason withdrawal right.

  • During checkout, we ask for a separate acknowledgement that the 14-day no-reason withdrawal right does not apply to a painting created after the order in the selected size, medium, and framing option.
  • For personal portraits, pet portraits, customer-uploaded or customer-sent reference materials, or works based on a unique brief, the same exclusion of the withdrawal right applies.
  • A full refund offered until the artist begins work is a voluntary cancellation option, not a substitute for or limitation of the statutory withdrawal right.
  • For online orders where a withdrawal right exists, we provide a separate online withdrawal function on the website during the withdrawal period. Receipt of the withdrawal statement is confirmed on a durable medium, typically by email.
  • Handmade variation, on its own, is not a defect if the work remains within the agreed concept, size, medium, and overall direction.

Exercising withdrawal and returning the artwork

If you have a withdrawal right, you may exercise it by sending a clear statement to legal@bpcanvas.com or by using the statutory model withdrawal form. The withdrawal statement should include your name, address, order ID, affected artwork, and the statement that you withdraw from the contract. The withdrawal statement is considered timely if you send it before the 14-day deadline expires.

  • If you withdraw, we refund the amount you paid within the statutory deadline, subject to applicable legal limits. Refunds are normally made using the original payment method unless we agree otherwise.
  • For goods sales, we may withhold the refund until we have received the artwork back or until the consumer has provided clear proof that it was returned, whichever is earlier.
  • The consumer must return or hand over the artwork within 14 days from communicating the withdrawal.
  • Return shipping costs are borne by you in case of consumer withdrawal, unless we agree otherwise or the law provides otherwise. For fragile, large, framed, or valuable artworks, return shipping may be significant and may require specialist courier or art-shipping handling; if the cost cannot be calculated precisely in advance, we coordinate this before return.
  • The artwork should be returned in the original packaging where possible, or otherwise in packaging providing equivalent protection. Lack of original packaging does not by itself exclude the withdrawal right, but you may be responsible for value reduction caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

Model withdrawal form

You may use the sample below, but you do not have to use this exact form if your intention to withdraw is clear.

  • I hereby declare that I withdraw from the contract for the sale of the following product: [artwork name / order ID].
  • Order date / delivery date: [date]. Consumer name and address: [name, address]. Date and signature if sent on paper.

Delivery and customer responsibilities

Paintings are shipped by tracked home delivery with suitable protective packaging. We do not use pickup points or parcel lockers for original paintings. You are responsible for providing accurate contact, delivery, and access details, and for receiving the shipment or following the carrier's delivery instructions.

  • For destinations outside our automatic checkout coverage, islands, overseas territories, oversized orders, or special delivery needs, we may require a custom quote before payment.
  • Delivery estimates start after dispatch, not from the date of order.
  • For deliveries outside the EU or to special customs or tax territories, you are responsible for any import duties, customs handling fees, or local taxes that are not collected at checkout.

Transit damage and defective performance

If an artwork arrives damaged, please contact us within 7 days with photos of the packaging and the artwork. This deadline helps carrier claim handling and evidence collection, and does not affect mandatory statutory warranty rights available to consumers.

  • Keep the packaging until we coordinate the information needed for damage handling.
  • If the issue does not appear to be transit damage, we review the report under the statutory warranty rules.

Statutory warranty, product warranty, and guarantee

For consumer purchases, defective performance is governed by statutory warranty rights under the Hungarian Civil Code and applicable consumer-protection rules. In case of defective performance, you may primarily request repair or replacement, unless the selected remedy is impossible or would impose disproportionate additional cost on us compared with another remedy. If we do not undertake repair or replacement, cannot perform it within an appropriate deadline, or your interest in repair or replacement has ceased, you may request a price reduction or withdraw from the contract under the statutory conditions. In a consumer sales contract, you may not repair the defect or have it repaired by another person at our expense within the statutory warranty framework.

  • For a product warranty claim, the consumer may enforce a claim against the manufacturer defined by law due to a product defect; who qualifies as manufacturer in a given case is determined under the applicable laws.
  • A mandatory guarantee applies only if the product is subject to mandatory guarantee by law. Budapest Canvas provides a separate voluntary guarantee only if expressly stated for a specific product or written offer.
  • Natural variation resulting from the hand-painted nature of the work, reasonable artistic difference between the concept and the final work, or a problem caused by improper handling, storage, or later damage does not by itself qualify as defective performance.

Authorship, certificates, and records

Each final canvas is signed by the artist and ships with a certificate of authenticity. The artist's name appears on the certificate unless a separate written privacy or confidentiality agreement requires a different arrangement.

  • We keep order, production, authorship, payment, and delivery records so we can support the artwork and comply with legal obligations.
  • Care instructions and documentation are part of the delivered artwork package where applicable.

Intellectual property and image use

Buying an artwork transfers ownership of the physical canvas after full payment, but it does not transfer copyright or other intellectual property rights unless we agree this in writing. You may display, resell, gift, and privately photograph the physical artwork. Commercial reproduction, licensing, merchandising, NFT use, or similar exploitation requires written permission.

  • For catalogue artworks and non-personal artworks, Budapest Canvas and the artist may use non-confidential images of the artwork, process, and finished piece for documentation, portfolio, editorial, and marketing purposes.
  • For personalised portraits, family or pet portraits, customer-supplied photos, references involving recognisable persons or private spaces, or confidential business projects, marketing or portfolio use is carried out only with separate consent or written agreement.
  • You may upload or send only reference materials that you are entitled to use and that do not infringe any third party's copyright, personality, or data-protection rights.

Liability, governing law, and mandatory rights

Nothing in these Terms limits liability for death or personal injury, fraud, intentional misconduct, gross negligence, or rights that cannot be limited by law. Subject to mandatory law, Budapest Canvas is not liable for indirect, incidental, or unforeseeable losses, and our responsibility for a particular order is limited to direct losses connected with that order.

  • Hungarian law applies to these Terms, without removing mandatory consumer protections that apply in your country of residence.
  • If any part of these Terms is invalid or unenforceable, the remaining parts continue to apply.

Complaints and consumer dispute resolution

We accept written complaints by email and post. If we provide a complaint form or other electronic complaint interface on the website, we promptly confirm receipt of the complaint at the email address provided by the consumer. If we provide telephone or other oral complaint-handling options, oral complaints are handled according to the law. Written complaints are answered substantively in writing no later than within 30 days. Rejections are reasoned. We keep the minutes taken for an oral complaint or the written complaint, as well as a copy of the substantive reply, for three years. In case of rejection, we provide information on which authority or conciliation board procedure you may initiate.
